DMCA Policy

Cinnamon Tea is committed to respecting the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement reported to our designated Copyright Agent.

This policy describes the information that should be present in a DMCA notice, the process for submitting a notice, and the process for submitting a counter-notification if your content has been removed due to an alleged infringement.

Filing a DMCA Notice of Claimed Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Cinnamon Tea website or services, please notify our Copyright Agent as set forth in the DMCA. For your notice to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the material that you claim is infringing and where it is located on the Cinnamon Tea website or services, including, at a minimum, the URL of the specific page or pages.
  4. Information reasonably sufficient to permit Cinnamon Tea to contact you, such as your address, telephone number, and email address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Filing a DMCA Counter-Notification

If your content has been removed from Cinnamon Tea's website or services as a result of a DMCA notice, and you believe that the material was removed or disabled by mistake or misidentification, you may send a counter-notification to our Copyright Agent. To be effective, a counter-notification must be a written communication that includes the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Cinnamon Tea may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
